Form 8 - Information for the Body Corporate Roll - Download this Form
An owner MUST complete and lodge this form with the Secretary (or Body Corporate Manager) if -
- they are a new owner
- or their circumstances have changed - ie address; email address; phone contact details; name change
The consequences for failure to ensure that the Roll of the Body Corporate is kept up to date are -
- levies (and penalty interest) can keep accruing in the name of the previous owner - the bad news is that the new owner is responsible for these levies and any penalty imposed
- The incoming owner could also lose any entitlement to any discounts for payment of levies on time
The accuracy of the information is also critical. For example, the Secretary of the Body Corporate (often the Manager is tasked with this job) requires the full name and street address of each owner including details of any power of attorney or in the case of a company the full name of the Nominee. Failure to provide this correctly could also invalidate any vote or right to vote by the owner.

Use this form if you would like a body corporate to make its records available, or to supply a copy of a record to you.
Section 205(2) of the Act requires a body corporate to make its records available or to supply a copy of a record, within 7 days of receiving a written request accompanied by the fee prescribed under the regulation module applying to the scheme. Section 205(4) of the Act requires a body corporate to issue a Body Corporate Information Certificate within 7 days of receiving a written request accompanied by the fee prescribed under the regulation module applying to the scheme. A certificate may be obtained within 24 hours by payment of an additional priority fee. The certificate may be faxed for an additional fee. A penalty may be incurred if the body corporate fails to comply with Section 205(2) or Section 205(4) of the Act.
NOTE: When requiring copies of documents (or any other record) you will need to be specific and will need to state which document you require - for example, copy of the Annual General Meeting held on 6 June 2020. It is quite difficult and time consuming for Body Corporate Managers to be requested to collate and send a list of documents. This takes them away from their core job of managing your building. It would be wiser to make an appointment with the Manager - pay the subscribed fee - then you can attend and copy any document you may require. Many software programs used by Body Corporate Managers allow owners to log in and retrieve documents relating to their scheme.
